Collection of general information

If you use our website for information purposes only, meaning if you do not create an account or provide us with any other information, we collect only the personal information that your browser transmits to our server. This includes the following: Content of the request (specific page), date and time of the request, quantity of data, web browser and web browser version, operating system, the domain name of your Internet provider, the referrer URL (the page from which you access our site), access status and the IP address.

Lawful basis is Article 6, paragraph 1, subsection 1, point (f) GDPR. Without this data, it would not be technically possible to deliver and display the contents of this website. In this respect, the collection of data is absolutely necessary. In addition, we use anonymous information for statistical purposes. This helps us to optimize our website and technology. Furthermore, we reserve the right to subsequently inspect log files if we suspect illegal use of our website.

Cookies

Our website uses cookies in order to recognize repeated use of our website by the same user/internet connection subscriber. Cookies are small text files that are placed and stored on your computer by your web browser. They make the website more user-friendly and effective overall. These cookies are mostly transient cookies, which are automatically deleted when you close the browser. Transient cookies include session cookies. These cookies save a session ID that is used for assigning various requests from your browser during a single session. This allows your computer to be recognized when you return to our website. Use of web analytics systems

Our website uses the privacy-compliant web analytics service Matomo for statistical analysis of website visits.Lawful basis is Article 6, paragraph 1, subsection 1, point (f) GDPR. Matomo uses cookies to analyze the usage patterns of website visitors. The usage information generated by the cookie (including your anonymized IP address) is transmitted to our server and stored for the purpose of subsequent evaluation and optimization of our website content. Even before your IP address is transmitted to our server, your IP address is anonymized so that you as a user remain anonymous to us. Information on how our website visitors use our website will not be passed on to third parties unless we are legally required to do so.

If you do not consent to the storage and analysis of this data from your visit, you can prevent the use of cookies by making a corresponding setting in your browser software. However, in this case you may not be able to use all the features of our website because your browser will block all cookies, not just the cookie that is stored on your computer for analysis purposes. Alternatively, you can object to the storage and use of this data at any time by clicking here. In this case, an opt-out cookie is stored in your browser and Matomo will not collect any session data. If you delete the cookies on your computer (for example if you use the private or incognito mode of your browser), the opt-out cookie will also be deleted and may need to reactivated by you so that no analysis cookie is stored on your computer.
 

Newsletter / Job Alerts

If you sign up for one of our newsletters, we save the information you provide for purposes of sending you the newsletter and providing information relevant to this service or the signup process. Lawful basis is Article 6, paragraph 1, subsection 1, point (a) GDPR. Click and open rates are analyzed in accordance with Article 6, paragraph 1, subsection 1, point (f) GDPR. Personal information is stored on the secured servers of our processor and will not be disclosed by us to third parties. Your valid e-mail address is required in order to receive the newsletter. You are not required to provide other highlighted information, which is used in order to address you personally. We also store the IP address you use to sign up for the newsletter and the date and time you subscribed to the newsletter. This information serves as evidence in the event of misuse if an unfamiliar e-mail is used to sign up for the newsletter. You can withdraw your consent to receive the newsletter at any time and unsubscribe from the newsletter. You can cancel your consent by clicking on the link included in each newsletter e-mail or by sending a message to our data protection officer mentioned above. We use the so-double-opt-in method for signup to our NewsClick Newsletter as well as our Career newsletter. This means that after you have signed up, we will send an e-mail to the specified e-mail address asking you to confirm that you wish to receive the newsletter. Your information will be automatically deleted if you do not confirm your signup within two weeks.

Contact form

If you contact us via an online form or by e-mail, we will store the information you have provided so that we can respond to your inquiry and ask any follow-up questions. Lawful basis isArt. 6, paragraph 1, subsection 1. point (a) GDPR unless establishing contact is justified for fulfillment of a contract in accordance with lawful basis Art. 6, paragraph 1, subsection 1 point (b) GDPR. We also forward your inquiry to the appropriate departments within our Group of companies where necessary to respond to your request. We delete the data collected for this purpose once storage is no longer required, or restrict processing if we are required by law to retain the data.

Creating an account on our website

If you create an account on our website in order to use personalized services, the personal information shown on the signup form will be collected. This includes your name, address and e-mail address, which are used for contacting and communicating with you. By creating an account, you gain access to services and content that are only available to registered users. When you log in to our site, we also store your IP address and the date and time of your login. This serves to protect us in the event that a third party improperly and without your knowledge makes use of your data to log in to our site. Lawful basis is Article 6, paragraph 1, subsection 1, point (b) GDPR. Signup cannot be completed unless the required information is provided.

Use of our BAUER store (www.bauer-products.de)

If you want to order products from our online store, you must provide personal information, which we require for processing your order and concluding the contract. Information required for the conclusion of contracts is highlighted; other information is voluntary. We process the data you provide in order to process your order. In doing so, we may pass on your payment information to our principal bank. The lawful basis for this is Article 6, paragraph 1  , subsection 1  point (b)  GDPR. The data is stored on a revocable basis in a customer account so that your information is available for subsequent purchases. You can manage the information of your user account in the customer area. To cancel your account you can send an e-mail to bag-webshop@bauer.de. We process your personal information as long as you maintain a customer account and as long as storage of the information is necessary in order to fulfill our contractual obligations. If the information is no longer required for fulfillment of contractual obligations, it is regularly deleted unless data retention requirements apply according to business and tax laws.

Use of our Career Portal (www.bauer.de/bauer_group/career/)

The personal information and files you provide in the Career Portal are used for the submission and processing of your online application. Your personal information is stored on the secure servers of our processor and also forwarded appropriately if there is a corresponding vacancy in an affiliated company or department of the BAUER Group. The information and files marked as mandatory fields are necessary for our internal requirements. This means that you cannot participate in the online application process if you do not provide us with this information.

If the application you submit is not successful, we will store the information and files in our database for a period of six months in order to answer questions related to your application. If you have submitted an unsolicited application or have consented to being included in our applicant pool, we will store your data and files for a period of two years so that we can consider you for future vacancies. After that, your personal information and files will be deleted from the Career Portal. If you successfully complete the application process, your personal information and files will continue to be used during your term of employment. The lawful bases for processing of personal information are  6 Article 1, subsection 1, point (a), point (b) GDPR and Article 9, paragraph 2. point (a) GDPR.

Use of our Customer Center (https://customercenter.bauer.de)

Our Customer Center is a customer and business partner portal that offers personalized online services such as a used equipment portal, a spare parts and information system as well as a feedback form (the above information on the contact form applies to the Customer Center). If you wish to use our Customer Center, you must sign up by specifying your personal information and position, which allows us to assign you the appropriate access permissions for the individual modules, and accept the terms of use for the portal. The signup process is not completed until you have been assigned access permissions for individual modules and you have logged into the forum using a password sent to you in a confirmation e-mail.

We use the personal information provided by portal users for technical management of the portal, checking their authorization for data access, supporting portal users with their data access (cookies, see above), for inquiries relating to your user account and/or for placed orders. We forward the personal contact information to other interested parties and registered users in the equipment portal once you have submitted a piece of equipment or accessory for sale in the portal or have sent us a request for a discontinued piece of equipment. The lawful basis for this is Article 6, paragraph 1  , subsection 1  point (b) of the GDPR.

You can manage the information of your user account in the customer area. To cancel your account, you can send us a message via the feedback form or an e-mail to service@bauer.de. We process your personal information as long as you maintain a user account and as long as storage of the information is necessary in order to fulfill our contractual obligations. If the information is no longer required for fulfillment of contractual obligations, it is regularly deleted unless data retention requirements apply according to business and tax laws.

Use of social media plug-ins

We currently use the following social media plug-ins: YouTube, Facebook, Xing, LinkedIn, RSS feed. We use the two-click method for these plug-ins. In other words, when you visit our site, initially no personal information is passed on to the provider of the plug-ins. The provider of the plug-in can be identified by its initial letter or logo on the icon. We allow you to communicate directly with the provider of the plug-in via the button. The plug-in provider is notified that you have opened the corresponding website of our online presence unless you activate the selected field by clicking it. The personal information that your browser sends to our server is also passed on. In the case of Facebook and Xing, the IP address is anonymized immediately after collection, according to the German companies of these providers. This means that when you activate the plug-in, your personal information is sent by you to the plug-in provider and stored there (in the USA in the case of US providers). Since the plug-in provider users cookies to collect data, we recommend that you delete all cookies in the security settings of your browser before clicking on the grayed-out icon.

We have no influence on the data collected and data processing operations, nor do we know the full extent of data collection, the purposes of processing or retention periods. Deletion of collected information also depends on the policies of plug-in providers. The plug-in provider stores the data collected about you as usage profiles and uses it for purposes of advertising, market research and/or tailored website design. This analysis, which also applies to anonymous users, is primarily used for placing custom ads and informing other users of the social network about your activities on our website. Data is passed on regardless of whether you have an account with the plug-in provider and are logged in to the provider's site. You have the right to object to the creation of these user profiles, but you must contact the respective plug-in provider to exercise this right. The plug-ins allow you to interact with social networks and other users so that we can improve our site and make it more interesting for you as a user. The lawful basis for the use of plug-ins is Article 6, paragraph 1, subsection 1, point (f) GDPR.

Embedded YouTube videos

Our website includes embedded YouTube videos that are stored at http://www.youtube.com and can be played directly from our website. All videos are embedded in "privacy-enhanced mode," meaning no data about you as a user is transferred to YouTube if you are not playing videos. The following data is not transferred until you play the videos. We have no influence on this data transfer.

In addition, the personal information that your browser sends to our server is forwarded to YouTube. Data security

We take technical and organizational security precautions to protect your data from unauthorized access. In addition to securing the operating environment, we use encryption in some areas (online application, customer account, contact form). The information you provide is then transmitted in encrypted form using the Secure Socket Layer (SSL) protocol to prevent misuse of your data by third parties. You can tell that a page is secure if the status bar of your browser has a closed padlock icon and the address bar has "https" in the prefix.

Rights of persons affected by the processing of personal information

You have the rights from the General Data Protection Regulation as well as the German Federal Data Protection Act, including the right to obtain information (Art. 15 GDPR), the right to rectification (Art. 16 GDPR), the right to erasure (Art. 17 GDPR), right to restriction of processing (Art. 18 GDPR), the right to object to processing (Art 21 GDPR) and the right to data portability (Art. 20 GDPR). Where processing of personal information is based on your consent, you have the right to withdraw your consent at any time without affecting the lawfulness of processing based on consent before its withdrawal.

Where we base the processing of your personal information on the balancing test for legitimate interest, you may object to processing. This is the case if processing is not necessary to fulfill a contract with you, which we describe in the above description of functions In the event of such an objection, we ask you to explain the reasons why we should not process your personal information as we have done. If your objection is justified, we will examine the situation and either stop or adjust data processing or demonstrate compelling legitimate grounds on the basis of which we will continue processing.

You also have the option to lodge a complaint to the above-mentioned data protection officer or to a data protection supervisory authority.
